WAIVER OF LIABILITY

By using the HomeStrong Fitness System, you acknowledge and agree to the following:

• You understand that the HomeStrong Fitness System is designed for users over the age of 18. If you are under the age of 18, you must have the permission and supervision of a parent or guardian to use the HomeStrong Fitness System. The HomeStrong Fitness System may not be safe for children under 18, even with adult permission and supervision.
• You understand that participating in physical exercise and fitness activities carries inherent risks, including, but not limited to, the risk of injury, illness, or death. Always consult with a physician before engaging in any exercise.
• You acknowledge that it is your responsibility to properly install the HomeStrong Fitness System according to the installation instructions provided. If the system is not installed properly, there is an inherent risk of property damage, serious bodily injury, and death.
• You agree to assume full responsibility for any and all injuries or damages that you may sustain as a result of using the HomeStrong Fitness System, including but not limited to injuries resulting from improper use of the system, injuries resulting from pinch points, injuries resulting from improper use of bands or using damaged bands, and injuries resulting from strangulation by the apparatus and/or bands that are not kept out of reach of infants, toddlers, and children.
• You acknowledge that at no time should infants, toddlers or children be left unsupervised around the HomeStrong System. The bands are a strangulation hazard for infants, toddlers, and children. Infants, toddlers, and children should not play with the HomeStrong System supervised or unsupervised. Strangulation can result in death, even with an adult present. 
• You assume the risk of any and all injuries or damage that could foreseeably arise from using the HomeStrong System. You therefore waive any and all claims that that you may have against HomeStrong Fitness, LLC for any claims, causes of action, or lawsuits for personal injury, death, or property damage sustained from the HomeStrong Fitness system.
• You understand and agree that the HomeStrong Fitness System constitutes an exercise regimen. Failure to consult a physician prior to use may result in serious injury or death. Even after consulting a physician, use may result in pain, soreness, discomfort, or injury. Consult a physician if you experience any of the above. Always call 911 immediately if you feel dizziness, light headedness, chest pain or shortness of breath during or after use. 
• HomeStrong Fitness, LLC makes no guarantee or warranty as to any particular result from use. Reviews, testimonials and product description do not constitute a guarantee that you will experience the same or similar results. You therefore expressly waive the right to bring any claim arising out of alleged false or misleading advertising.
• You acknowledge that you have carefully read this Waiver of Liability and fully understand its contents.
• You are aware that this is a release of liability and a binding contract between you and HomeStrong Fitness, LLC, and you acknowledge it and have accepted it of your own free will.

I understand that by signing this Waiver, I expressly and willingly agree to assume complete responsibility for any risk of injury or death or property damage that may arise while using the HomeStrong Fitness System. 

I HAVE READ AND FULLY AGREE TO THE TERMS OF THIS WAIVER. I UNDERSTAND AND CONFIRM THAT BY SIGNING THIS WAIVER AND RELEASE I HAVE GIVEN UP CONSIDERABLE FUTURE LEGAL RIGHTS. I HAVE SIGNED THIS WAIVER FREELY, VOLUNTARILY, UNDER NO DURESS OR THREAT OF DURESS, WITHOUT INDUCEMENT, PROMISE, OR GUARANTEE BEING COMMUNICATED TO ME. MY SIGNATURE IS PROOF OF MY INTENTION TO EXECUTE A COMPLETE AND UNCONDITIONAL WAIVER AND RELEASE OF ALL LIABILITY TO THE FULL EXTENT OF THE LAW. I AM 18 YEARS OF AGE OR OLDER AND MENTALLY COMPETENT TO ENTER GRANT THIS WAIVER.

LIMITED PRODUCT WARRANTY

The Limited Product Warranty for HomeStrong Fitness, LLC is as follows:

HomeStrong Fitness System, LLC (“HomeStrong Fitness”) warrants to the original purchaser that all authentic HomeStrong Fitness Systems shall be free from defects in material and workmanship under normal use and service for the following periods and in the following respects:

• HomeStrong System Resistance Bands (including those included with the HomeStrong Fitness System and those sold separately, such as Individual, Single, and Double Band Sets): 1 year from the date of purchase.
• HomeStrong Fitness System (Vertical and Horizontal Anchoring System, and Resistance Bar): Limited Lifetime Warranty. HomeStrong Fitness warrants the system against defects in workmanship and materials for the lifetime of the product, with the exception of corrosion or damage caused by use other than that outlined in the product use guide or exceeding the rating limitations.
• HomeStrong Fitness System Accessories: 1 year from the date of purchase. Accessories include Carabiners, Ankle/Wrist Straps, Resistance Handles, Dip Rings and Straps, Suspension Trainer, and any other accessories purchased from HomeStrong Fitness. Accessories purchased through affiliate sites, wholesalers, or retail sources are not covered under this warranty.

If a defect arises within the applicable Limited Warranty period, the original purchaser’s sole and exclusive remedy is for HomeStrong Fitness to, at their discretion, replace or repair the defective equipment or component. A subsequent purchaser shall have no remedy against HomeStrong Fitness.

Exclusions and Limitations:

• Any sale of HomeStrong Fitness products by an unauthorized source or by any other manner not authorized by HomeStrong Fitness, LLC shall void the warranty on the applicable product(s).
• This warranty applies only to the original purchaser and is not transferable.
• HomeStrong Fitness will not be liable for any special, indirect, incidental, secondary or consequential losses, damages, or expenses in connection with HomeStrong Fitness products.
• Exposure of the products to variations in ambient environmental conditions may void the warranty.
• This warranty does not cover normal wear and tear, including but not limited to impact damage, indentations, scratches, surface damage, rust, bending due to misuse, or any defect caused from use outside the stated function of the product.
• This warranty does not cover damage that is not a result of a manufacturing defect, including, but not limited to, improper assembly, inadequate maintenance, or installation of other parts or components not manufactured or supplied by HomeStrong Fitness, LLC.
• This warranty does not cover damage or failure as a result of an accident, abuse, neglect, misuse, corrosion, use of the device other than its intended purpose, neglect, theft, vandalism, fire, flood, lightning, freezing or other natural disasters, collision, or unauthorized modifications.

This warranty gives the original purchaser specific legal rights, and they may also have other rights which vary from state to state. This Limited Product Warranty for HomeStrong Fitness, LLC is the only express warranty applicable to the product and supersedes any prior or contemporaneous oral or written representations or warranties.
